Terms of Service

1. The Service

AlertVista is a website and uptime monitoring service. It periodically checks the URLs, hosts, and domains you configure and notifies you when it detects downtime, certificate or domain-expiry issues, or other conditions you set. Features and limits depend on your plan.

2. Accounts and eligibility

You must provide accurate information and are responsible for activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract. Keep your login credentials secure; you are responsible for safeguarding them.

3. Acceptable use

You agree not to use the Service to:

• monitor systems you do not own or lack permission to monitor;
• probe, scan, or send excessive requests to third-party systems in a way that is abusive or unlawful;
• violate any law, infringe others' rights, or transmit malware;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure; or
• resell or provide the Service to third parties except as expressly permitted.

4. Plans, billing, and refunds

The Service offers free and paid plans. Paid subscriptions are billed in advance through our payment processor, Polar. By subscribing, you authorize recurring charges for your plan until you cancel. You can cancel at any time; your plan remains active until the end of the current billing period. Except where required by law, payments are non-refundable. If a payment fails, we may pause or downgrade your account after a grace period.

5. Service availability and monitoring disclaimer

We work to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation, and we do not guarantee that every incident on your monitored systems will be detected or that every alert will be delivered on time. Monitoring depends on networks, third-party providers, and configurations outside our control. The Service is a supplementary tool and must not be your sole safeguard against downtime or data loss.

6. Your content

You retain ownership of the data you submit (such as monitored URLs and alert settings). You grant us the limited right to process that data solely to operate and provide the Service. You are responsible for ensuring you have the right to monitor the targets you configure.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by AlertVista and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends and we may delete your data in line with our Privacy Policy.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, AlertVista will not be liable for any indirect, incidental, or consequential damages, or for lost profits, revenue, or data, arising from your use of or inability to use the Service — including missed or delayed alerts. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts located in India.
